Freedomology Products

These Terms & Conditions (the “Terms”) form a legally binding agreement between you (“you” or “User”) and Freedomology, LLC (“Freedomology,” “we,” “us,” or “our”) governing your access to and use of our websites, web applications, and related services (collectively, the “Services”). By accessing or using any part of the Services, you agree to be bound by these Terms.

We do not market or provide the Services to individuals located in the European Economic Area.

 

1. Eligibility & Account Registration

You must be at least 18 years old and reside in the United States to create an account. You agree to provide accurate, complete, and updated information and maintain the security of your login credentials.

 

2. License to Use the Services

We grant you a personal, revocable, non‑exclusive, non‑transferable, limited license to access and use the Services solely for your internal business or personal purposes and strictly in accordance with these Terms. We (and our licensors) retain all rights not expressly granted herein.

 

3. User Content

“User Content” means any data, text, images, or other material that you upload or transmit through the Services.

  1. Limited License to Freedomology. You grant Freedomology a worldwide, royalty‑free license to host, process, display, and reproduce User Content only as needed to operate, improve, and provide the Services to you and other users. We do not sell or otherwise commercialize your User Content.
     

  2. Responsibility. You represent that you own or have the necessary rights to post User Content and that doing so does not violate any law or the rights of any third party.

 

4. Acceptable Use

 

You agree not to:

  • Violate any applicable law or regulation;
     

  • Post unlawful, infringing, or misleading content;
     

  • Reverse engineer or attempt to obtain source code of the Services;
     

  • Introduce viruses or malicious code;
     

  • Use automated means (bots, scrapers) without our prior written permission.
     

We may suspend or terminate access for violations.

 

5. Subscriptions & Billing (if applicable)

 

If we launch paid subscription plans:

  • Pre‑Purchase Disclosures (CA Automatic Renewal Law). We will clearly present the price, billing interval, renewal terms, and cancellation method before you complete a purchase and in the post‑purchase confirmation email.
     

  • Cancellation. You may cancel at any time via your account settings or by emailing billing@freedomology.com. Cancellation takes effect at the end of the current billing period.
     

  • Refunds. Unless required by law, payments are non‑refundable.
     

 

6. Intellectual Property

 

All content, trademarks, logos, and software that form part of the Services are the property of Freedomology or its licensors and are protected by U.S. and international intellectual property laws.

 

7. Third‑Party Services

 

The Services may integrate or link to third‑party platforms (e.g., AI model providers). We are not responsible for third‑party content or practices; your use of those services is subject to their terms.

 

8. Disclaimers

 

The Services are provided “AS IS” and “AS AVAILABLE.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, non‑infringement, and that the Services are error‑free or uninterrupted. Nothing in these Terms disclaims any warranties or liabilities that cannot be disclaimed under applicable law.

 

The Services may include AI‑generated content. **AI outputs can be inaccurate or incomplete, and they do not constitute legal, medical, financial, investment, health, relationship, or any other form of professional advice. You acknowledge that Freedomology is not a licensed financial advisor, broker‑dealer, investment adviser, healthcare provider, therapist, or attorney, and that no fiduciary or professional relationship is created by your use of the Services. All content is provided for informational purposes only, and you agree to consult qualified professionals before acting on any information.

 

No Professional Advice

 

The Services, including all AI‑generated outputs, are intended solely to provide generalized information. They are not a substitute for professional judgment. You must evaluate all information and bear sole responsibility for any decisions or actions you take based on the Services. Freedomology expressly disclaims any liability arising from or relating to your reliance on any content obtained through the Services.

 

No Warranties

 

We make no representation or warranty that any advice, prediction, or recommendation provided by the Services will be accurate, complete, or suitable for your circumstances. You understand that using or relying on any information is at your own risk.** You are solely responsible for verifying information before relying on it.

 

 

9. Limitation of Liability

 

To the maximum extent permitted by law, Freedomology and its directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenues, or data, arising out of or related to your use of the Services.

 

Carve‑Outs. Nothing in this section limits or excludes liability for (a) gross negligence or willful misconduct; (b) death or personal injury resulting from negligence; or (c) any liability that cannot be limited under applicable law (including California Civil Code §1668).

 

Our total aggregate liability for any claim arising out of or relating to these Terms or the Services will be limited to the greater of (i) $100 or (ii) the amount you paid us (if any) in the 12 months preceding the event giving rise to liability.

 

10. Indemnification

 

You will defend and indemnify Freedomology from and against any third‑party claims, damages, or expenses (including reasonable attorneys’ fees) arising out of your breach of these Terms or your misuse of the Services.

 

11. Governing Law & Dispute Resolution

 

11.1 Governing Law

 

These Terms are governed by the laws of the State of Ohio, without regard to its conflict‑of‑law rules.

 

11.2 Binding Arbitration & Class Action Waiver

 

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.

  1. Arbitration. Any dispute arising out of or relating to these Terms or the Services that cannot be resolved informally will be resolved by final and binding arbitration administered by JAMS (or AAA if JAMS is unavailable) in accordance with its Streamlined Rules. The arbitration will take place in Cleveland, Ohio, unless we agree otherwise.
     

  2. Small Claims Court. Either party may pursue a claim in small claims court in Cuyahoga County, Ohio, if the claim is within that court’s jurisdiction.
     

  3. Class Action Waiver. You and Freedomology agree that any claims will be brought solely in your or our individual capacity, and not as a plaintiff or class member in any purported class or representative proceeding.
     

  4. Opt‑Out. You may opt out of this arbitration agreement within 30 days of first accepting these Terms by emailing legal@freedomology.com with your full name and a clear statement that you wish to opt out.
     

 

12. California Consumer Notices

 

In accordance with California Civil Code §1789.3, you may contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs in writing at 1625 North Market Blvd., Suite N‑112, Sacramento, CA 95834, or by telephone at (800) 952‑5210.

 

13. Termination

 

We may suspend or terminate your access to the Services at any time if you violate these Terms or if we discontinue the Services. Upon termination, all provisions that by their nature should survive will survive (e.g., Sections 7–10, 11.2, and 15).

 

14. Changes to the Terms

 

We may revise these Terms from time to time. If we make material changes, we will notify you by posting the updated Terms and updating the “Last Updated” date. Continued use of the Services after the changes become effective constitutes acceptance of the revised Terms.
